Giantomasi Oliveira

Newark, New Jersey Eminent Domain Attorneys

Condemnations require careful legal planning, multiple financial and environmental impact studies, and an ability to work with communities affected by development. Since the definition and law surrounding what constitutes blight can be very technical and involved, an ability to use studies in conjunction with established case law and Constitutional principles is vital.

The law office of Giantomasi & Oliveira has worked on condemnation cases involving several large scale developments in Newark, including the construction of the Newark Arena, home of the New Jersey Devils hockey team. Our office has represented both the County of Essex and the State of New Jersey in eminent domain cases involving major development and public works projects. We've also represented businesses and individuals in opposing the exercise of eminent domain when the reasons for taking and condemning property were not justified.

Our attorneys have the legal experience and access to expert witness resources needed in eminent domain cases. For more information regarding your rights in either exercising or opposing takings, contact the Newark law office of Giantomasi & Oliveira today.

Condemnation

Condemnation and Takings

The law office of Giantomasi & Oliveira represents businesses and individuals in regard to the following:

  • Blight
  • Condemnation
  • Public works projects
  • Real estate development
  • Zoning and planning issues
  • Environmental impact studies
  • Assessing fair market value of property
  • Environmental clean up of underused property

Blight and Redevelopment

According to Article VIII, § III of the New Jersey state Constitution, blighted areas can be redeveloped when a public use or public purpose is involved:

"The clearance, replanning, development or redevelopment of blighted areas shall be a public purpose and public use, for which private property may be taken or acquired."

Due to a somewhat open-ended definition of blight in the New Jersey Constitution, most takings involve disputes centered round whether an area is actually blighted or not. Our office has been highly successful in working with teams of experts, public officials, and government agencies in determining when an area meets the Constitutional standard of blight.

Economic Redevelopment and Takings

Typically, redevelopment in Newark involves vacant or unused industrial areas where manufacturing has left heavy metals and other pollutants in the environment. When property has been left vacant or unused for a certain period of time, a condemnation may be justified, depending on proposed development plans for the area and environmental clean up involving the New Jersey Department of Environmental Protection. Our office can coordinate studies and prepare all necessary legal documents for developers in cases involving vacant and under utilized property.
